Welcome to Bambino, a marketplace platform that connects buyers and sellers of baby and children‘s items. These Terms of Service ("Terms") govern your use of the Bambino website and mobile application (collectively, the "Service") operated by Bambino Inc. ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Definitions

4.2 Prohibited Items

You may not list the following items:

Recalled or unsafe products
Items that don‘t meet current safety standards
Expired or damaged baby food, formula, or medications
Used car seats (safety cannot be verified)
Handmade cribs or sleep products that don‘t meet safety standards
Counterfeit or stolen goods
Items prohibited by local, state, or federal law

5. Seller Responsibilities

As a Seller, you agree to:

Provide accurate and complete descriptions of your items
Use your own photos or clearly indicate if photos are stock images
Set fair and reasonable prices
Respond to buyer inquiries promptly
Ship items within the timeframe specified in your listing
Package items securely to prevent damage
Honor the terms of any sale
Pay applicable fees and taxes

6. Buyer Responsibilities

As a Buyer, you agree to:

Pay for items promptly upon purchase
Provide accurate shipping information
Communicate respectfully with sellers
Inspect items upon receipt
Report any issues within a reasonable timeframe
Use items safely and according to manufacturer guidelines

7. Payments and Fees

Bambino uses third-party payment processors to handle transactions. We may charge the following fees:

Transaction fees on completed sales
Payment processing fees
Premium listing fees (if applicable)

All fees will be clearly disclosed before you incur them. Fees are non-refundable except as required by law.

8. Disputes and Returns

Bambino encourages buyers and sellers to resolve disputes directly. We provide communication tools and mediation services to help resolve issues.

Return policies are set by individual sellers. Buyers should review return policies before making a purchase. We may intervene in cases of fraud or significantly misrepresented items.

9. Prohibited Conduct

You agree not to:

Violate any laws or regulations
Infringe on intellectual property rights
Post false, misleading, or fraudulent listings
Harass, abuse, or threaten other users
Spam or send unsolicited messages
Attempt to circumvent our fee structure
Use automated tools to access the Service
Interfere with the operation of the Service
Create multiple accounts to evade restrictions

SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
